Terms

The agreement, in plain English

The same commercial terms used in the private booking journey, available here before you enquire or sign.

Before you rely on these terms

These are Wayne Myers’ current standard wedding-photography terms. Your private booking agreement also records your names, collection, price, wedding date, venue, payment schedule and signatures.

If an individually signed variation changes a detail for your wedding, that signed variation applies. Ordinary messages and conversations do not amend the agreement.

The contract version currently in use is 2026-10-06.2. Questions and contractual notices can be sent to info@thebeardedweddingphotographer.co.uk.

The agreement

This agreement is between Wayne Myers, trading as The Bearded Wedding Photographer, of 55 Park Road, Darwen, BB3 2LB (the Photographer), and both clients named in the booking form (the Couple). Both clients must be at least 18 and are jointly and individually responsible for the agreement and its payments. A third party may pay on their behalf but gains no right to change or cancel the booking.

Securing the date

The date is held provisionally for seven calendar days. It is secured only when both clients have signed and the booking deposit has cleared. If either is missing, the Photographer will give 24 hours’ final notice before the date may be released.

Price and payments

The package, total price and bank-transfer schedule shown in this booking form are part of the agreement. Payments are rounded to the nearest pound. A missed payment must be corrected within 48 hours of written notice. The Photographer may then suspend work or terminate. Sums retained will be limited to completed work, reasonably incurred expenses and genuine direct loss after reasonable steps to reduce that loss. A third-party payment is credited to the Couple, and any refund is normally returned to the account from which it was received.

Coverage

The package includes up to ten consecutive hours. One photographer cannot cover simultaneous events in different places. The Complete Story includes Wayne and a trusted second photographer throughout the agreed coverage. Guest Eye View is candid coverage from a guest’s point of view: it does not include formal or organised group photographs or directed posing, although a photograph may be taken spontaneously when a guest asks. Where Guest Eye View is booked with a second photographer, that photographer attends throughout the agreed coverage. An upgrade that adds a second photographer (The Solo Story to The Complete Story, or adding a second photographer to Guest Eye View for £350) requested at least six months before the wedding guarantees a second photographer; later requests are subject to availability and require a revised agreement showing the price difference. Requested images and any particular image count are not guaranteed. A discretionary delay allowance of up to 30 minutes may be given. Further time is £150 for each started hour, to a maximum of three hours, authorised and paid before it begins.

Planning and access

The Couple will provide the final timetable, locations, restrictions and key contacts two weeks before the wedding. For The Solo Story and The Complete Story, around ten group arrangements are recommended and the Couple will nominate someone to assemble the relevant people; Guest Eye View includes no organised group photographs. The Photographer is not responsible for missed images caused by lateness, absence, non-cooperation, simultaneous events, venue or officiant restrictions, weather, lighting or obstruction by guests or other suppliers.

Travel and other suppliers

The agreed price includes travel and accommodation unless the booking details state otherwise. Any additional travel or accommodation identified from information supplied later will be discussed and added only by signed variation. Video, drone and content-creation services are not included. The Photographer may recommend independent suppliers but is not a party to, or responsible for, their services. Guests and other suppliers may photograph or film provided they do not obstruct coverage or compromise safety.

Meals, breaks and safety

For full-day coverage the Couple will arrange a hot meal for each photographer while the Couple eats. The approximately one-hour meal break and reasonable welfare, refreshment and equipment breaks remain within coverage time. If no suitable meal is provided, the photographers may leave to obtain food. The Photographer may stop work where there is violence, threats, harassment, dangerous intoxication, illegal activity, unsafe conditions or threatened damage or theft. When safe, the Couple or venue will first be given an opportunity to resolve the problem.

Selection, editing and delivery

The Photographer retains artistic control over selection, colour, crop and finish. RAW, rejected and unedited files are never supplied. Responsible AI-assisted tools may be used where they benefit an image, with Wayne retaining editorial control. Genuine processing mistakes may be corrected. Extensive retouching is £25 per selected image. A preview of approximately ten images is targeted within seven calendar days and the full online gallery within five working weeks.

Gallery, products and archive

The included gallery remains available for 12 months. Continued hosting may be offered at £5 per month; after two missed payments it may be removed following notice. The Couple must download and back up the delivered files. The Photographer targets a five-year archive but does not guarantee indefinite storage. Archive retrieval is £50. The Photographer may change gallery or fulfilment supplier and will take reasonable steps to transfer an active gallery; appearance, products and features may differ. Prints, albums and merchandise ordered through the gallery shop are separate purchases subject to the displayed supplier and fulfilment terms.

Copyright and licence

Copyright remains with the Photographer. The Couple receives a permanent, worldwide, non-exclusive personal-use licence to download, print and share the delivered photographs. Commercial use, sale, substantial alteration, filters or AI manipulation are not permitted. Suppliers must obtain a commercial licence directly from the Photographer. Publication or competition submission by the Couple is permitted with credit.

Marketing choice and privacy

Marketing permission is optional, granular and does not affect price or service. It may be withdrawn for future use by email. The Photographer will remove material under his control where reasonably practicable but cannot recall printed material, third-party publication or copies already distributed. The Couple will identify children or guests requiring special privacy; prominent promotional use of an identifiable child requires appropriate parent or guardian authority.

Cancellation and postponement

Cancellation must be emailed and confirmed by both clients. Completed work and non-recoverable expenses remain payable. Any further cancellation amount will reflect genuine direct loss, less saved costs and income from successfully rebooking the date. Refunds due are made within 30 days. If the Couple separates and one client wishes to arrange a different event, the original agreement ends under these cancellation terms and any new service requires a new contract. One postponement may be requested at least eight weeks before the wedding. A replacement date must be agreed within 60 days, occur within 18 months and is subject to availability and current additional costs. A second postponement is treated as cancellation unless agreed otherwise.

Illness and events beyond control

If Wayne cannot attend, he will first seek a suitably experienced associate and, where possible, retain editing and delivery. If no suitable replacement is available, fees for unperformed services are refunded. If only the second photographer cannot be replaced, the second-photographer element is refunded: the difference between The Complete Story and The Solo Story, or the £350 second-photographer fee for Guest Eye View. For events genuinely beyond reasonable control, both sides will first try to adapt or postpone; any termination and refund will account fairly for delivered services and reasonable non-recoverable costs.

Equipment, loss and liability

The Photographer carries backup cameras and records to dual memory cards. Partial image loss gives a proportionate remedy; total loss before delivery gives a refund of photography service fees. A replacement portrait session may be offered by agreement. Liability is normally limited to the contract price, except for fraud, deliberate misconduct, death or personal injury caused by negligence, or anything the law does not permit to be limited. Statutory consumer rights are unaffected.

Complaints and law

Complaints should be emailed to info@thebeardedweddingphotographer.co.uk. They will be acknowledged within five working days and answered within 20 working days. Both sides will attempt good-faith resolution and may consider mediation. The law and courts of England and Wales apply.

Changes and notices

Contractual notices may be sent by email. Changes require a written variation digitally signed by Wayne and both clients. Discussion alone does not amend the agreement. If one term is unenforceable, the remainder continues. Delay in enforcing a term is not a waiver. No third party has rights under this agreement.
